假釋的實(shí)質(zhì)條件有哪些？
(一)適用假釋的對(duì)象條件
適用假釋的對(duì)象只能是被判處有期徒刑和無(wú)期徒刑的犯罪分子。
在適用假釋的對(duì)象條件中還有一個(gè)限制條件，即對(duì)累犯以及因殺人、爆炸、搶劫、強(qiáng)奸、綁架等暴力性犯罪被判處10年以上有期徒刑、無(wú)期徒刑的犯罪分子，不得假釋。
(二)適用假釋的刑期條件
被判處有期徒刑、無(wú)期徒刑的犯罪分子只有執(zhí)行了一定的刑期之后才能適用假釋?zhuān)驗(yàn)橹挥型ㄟ^(guò)一定時(shí)間的刑罰執(zhí)行，才能確切地掌握犯罪分子是否有悔改表現(xiàn)，是否會(huì)再危害社會(huì)。
(三)適用假釋的實(shí)質(zhì)條件
被判處有期徒刑、無(wú)期徒刑的犯罪分子在刑罰執(zhí)行期間，必須認(rèn)真遵守監(jiān)規(guī)，接受教育改造，確有悔改表現(xiàn)，不致再危害社會(huì)。
對(duì)于犯罪分子的假釋?zhuān)勒招谭ㄒ?guī)定的程序進(jìn)行。非經(jīng)法定程序不得假釋。
假釋的實(shí)質(zhì)條件有哪些？
假釋?zhuān)菍?duì)被判處有期徒刑、無(wú)期徒刑的犯罪分子，在執(zhí)行一定刑期之后，因其遵守監(jiān)規(guī)，接受教育和改造，確有悔改表現(xiàn)，不致再危害社會(huì)，而附條件地將其予以提前釋放的制度。關(guān)于適用假釋的條件，根據(jù)刑法第81條的規(guī)定，假釋必須符合以下條件：
1.適用假釋的對(duì)象條件，只能是被判處有期徒刑的犯罪分子和被判處無(wú)期徒刑的犯罪分子兩種人。被判處管制的犯罪分子因本身是不予關(guān)押，不存在假釋問(wèn)題;被判處拘役的犯罪分子因刑期較短，也不必要規(guī)定假釋制度;死刑犯也不存在假釋問(wèn)題，被判處死緩的犯罪分子本身也不存在假釋問(wèn)題，要有也是發(fā)生在改為無(wú)期徒刑或者有期徒刑以后。在適用假釋的對(duì)象條件中，有例外情況，即對(duì)累犯以及因殺人、爆炸、搶劫、強(qiáng)奸、綁架等暴力性犯罪被判處10年以上有期徒刑、無(wú)期徒刑的犯罪分子，不得假釋。
2.適用假釋的刑期條件，必須是被判處有期徒刑的犯罪分子，實(shí)際執(zhí)行原判刑罰二分之一以上;被判處無(wú)期徒刑的犯罪分子，實(shí)際執(zhí)行原判刑罰10年以上。這樣規(guī)定一方面是為了維護(hù)法律的嚴(yán)肅性，保證被判刑的犯罪分子要實(shí)實(shí)在在服幾年刑，受到應(yīng)有的懲罰、教育和改造;同時(shí)，也只有在對(duì)被判無(wú)期徒刑和有期徒刑的人實(shí)際執(zhí)行一定的刑期，經(jīng)過(guò)一段時(shí)間的改造以后，執(zhí)行機(jī)關(guān)和司法機(jī)關(guān)才能據(jù)此分析犯罪分子的悔改情況，判斷是否會(huì)再危害社會(huì)，才能保證適用假釋的準(zhǔn)確性。在適用假釋的刑期條件中，也有一個(gè)例外規(guī)定，即如果有特殊情況，經(jīng)最高人民法院核準(zhǔn)，可以不受上述執(zhí)行刑期的限制。這一規(guī)定體現(xiàn)了原則性與靈活性的統(tǒng)一。這里所謂的“特殊情況”，主要是指出于國(guó)家政治、國(guó)防、外交等方面特殊需要。

在一般情況下，適用假釋的上述三個(gè)條件必須同時(shí)具備，缺一不可;只具備其中一個(gè)或者兩個(gè)條件的，不得適用假釋。
